This website is operated by Skaba Creative, a UK-based design company, on behalf of the artist Elsa Heinesen, an independent visual artist based in Denmark.

By using this website or placing an order, you agree to these Terms & Conditions.

All artworks sold on this website are original, one-of-a-kind works of art created by Elsa Heinesen.

Each painting is unique, and only one exists unless explicitly stated otherwise.

Purchasing an artwork does not transfer copyright ownership (see Section 10).

All prices are listed in Euros (EUR) unless otherwise stated.

Prices may be updated at any time without notice. However, confirmed orders will not be affected.

Payments are processed securely via third-party providers:

• Stripe 
• PayPal 

We do not store or have access to full payment card details.

An order is only confirmed once full payment has been successfully received.

We reserve the right to refuse or cancel orders in cases of pricing errors, suspected fraud, or product unavailability.

Delivery times are estimates only and may vary depending on destination and courier services.

Once an artwork has been dispatched, responsibility for safe delivery passes to the buyer.

We are not responsible for delays caused by postal or courier services outside our control.

Due to the nature of the products sold:

• All original paintings are final sale and non-returnable 
• No refunds or exchanges will be offered once a painting has been purchased 

Each artwork is a unique, one-of-a-kind piece and cannot be replaced or restocked.

This does not affect your statutory rights in cases where an item arrives damaged or significantly not as described. In such cases, you must contact us within 7 days of delivery with photographic evidence.

Once an artwork has been delivered, responsibility for its care and maintenance passes to the buyer.

We recommend artworks are:

• Kept out of direct sunlight 
• Stored in stable temperature and humidity conditions 
• Handled carefully when moved or displayed 

We are not responsible for deterioration, damage, or changes to the artwork after delivery.

Where commissioned work is offered:

• A deposit may be required before work begins 
• Work will begin only after written agreement (email confirmation is sufficient) 
• Timelines are estimates and may vary depending on complexity 
• Revisions are limited to what is agreed in advance 

Commissioned works are non-refundable once work has commenced.

All artworks, images, and content on this website remain the intellectual property of Elsa Heinesen, unless otherwise stated.

You may not:

• Reproduce artworks 
• Use images commercially without permission 
• Resell or distribute artwork images in any form 

Purchasing an artwork does not grant any reproduction or copyright rights.

We are not liable for:

• Delays outside our control (including courier delays) 
• Damage occurring after delivery 
• Environmental effects on artworks after receipt 
• Minor variations in colour between digital images and physical artwork 

Nothing in these Terms excludes liability where it would be unlawful to do so.

These Terms & Conditions are intended to comply with applicable international consumer protection laws.

The website is operated and maintained by Skaba Creative (United Kingdom) on behalf of Elsa Heinesen (Denmark).

To the extent permitted by law:

• These Terms are governed by the laws of Denmark, where the artist is based. 
• Depending on your country of residence, you may also have rights under mandatory local consumer protection laws, including within the European Union. 
• Consumers may be entitled to bring claims in their country of residence where required by applicable law. 

Nothing in these Terms affects your statutory consumer rights.

We may update these Terms & Conditions from time to time. The latest version will always be available on this page.
